Owner of unlawful trees destruction prosecuted
A Waltham Abbey resident was successfully prosecuted for the unlawful destruction of 2 preserved trees.
Saba Kiran from Mill Lane in Waltham Abbey was prosecuted for the destruction of 2 preserved trees, an oak and an ash, at Chelmsford Magistrates’ Court on 20 February 2025.
Trees felled without consent
The Court found that Ms Kiran had felled the trees without consent from Epping Forest District Council, despite knowing that they were protected by tree preservation orders (TPOs).
In recognition of the seriousness of the offences and the valuable contribution that the trees made to the amenity of the local area, Ms Kiran was fined a total of £6,345. She was also ordered to pay a victim surcharge of £190 and £12,000 towards the council’s costs.
What is a preserved tree?
Not all trees are protected but many are. Before undertaking pruning or removal of trees you should check whether the trees are protected, as prior permission may be required for the work.
Visit the tree preservation orders (TPO’s) page on our website for information and contact details.
Contact us before starting any work
The council attaches great importance to the protection of preserved trees in the Epping Forest district. They help fight climate change, provide habitats for wildlife and improve our health.
We have a tree team who are here to help. Contact them for advice before starting any tree work, it’s free and they may save you a costly court appearance.
I hope this prosecution will deter those considering carrying out similar offences in the future.
